The EU Climate Law

Two days ago, the European Commission published a proposal for the European Climate Law, which consists a part of the European Green Deal and aims to create a stable legal framework for a more sustainable future.  The objective of the European Climate Law is to to become climate-neutral continent by 2050, by cutting emissions and increasing the removals of greenhouse gases from the atmosphere to reach net-zero emissions. It also aims to motivate and enhance efforts on adaptation to climate change.

This effort will be achieved through the revision of the European Emissions Trading System (EU-ETS) Directive, the Effort Sharing Regulation, the Land use, land use change and forestry (LULUCF) Regulation, the Energy Efficiency Directive, the Renewable Energy Directive and the CO2 emissions performance standards for cars and vans.

The proposal sets a mechanism and provides flexibility to ensure that the EU improves its adaptive capacity to the impacts of climate change. The EU Climate Law actions will be adapted accordingly based on existing systems such as the the process of  Member States’ national energy and climate plans,  reports by the European Environment Agency, and the latest scientific evidence on climate change and its impacts. The goal of the actions is to ensure that EU policies contribute to the transition to the climate neutrality. The process will be assessed every five years by the European Commission, aligned with the Paris Agreement timelines.  

In parallel, European Commission will launch a new EU Adaptation Strategy and the European Climate Pact, which will help to accomplish the objectives of EU Climate Law.

The main funding tool of this initiative is the European Green Deal Investment Plan, which is one of the the Commission's proposals for the future long-term budget 2021-2027 and will mobilise €1 trillion in sustainable investments. The Just Transition Mechanism which includes the Just Transition Fund is a part of this plan and will ensure that the transition is fair and equal for all regions and sectors. Furthermore, the InvestEU programme which proposed in 2018 will play an important role in promoting sustainable investments and will help public and private project promoters to develop green investment projects.

The legislative proposal was submitted to the European Parliament, the Council, the Economic and Social Committee and the Committee of the Regions for further consideration under the ordinary legislative procedure.
